Mr. Watkins:

Excellent article.

However, the government has had this power for quite some time. Please see my 2002 article on CapMag: "The Right to Free Speech Applies to Businessmen Too" (http://www.capmag.com/article.asp?ID=1616). Here're are the pertinent lines:

"[There are] three legal requirements for those engaging in commercial speech, called the "Central Hudson Test" (from: Central Hudson Gas & Electric v Public Service Commission).

"[...]

"Comes now, however, the third requirement. The government can regulate commercial speech if:

"The government's interest in restricting the speech is substantial, the regulation in question directly advances the government's interest, and the regulation is no more extensive than necessary to serve the government's interest[1] [emphasis added]."

Keep up the good fight.

I'm need some clarification here. On the one hand: "...Humana makes about half its money from the program..." and then sends out warnings on potential cuts to the program. In essence biting the hand that feeds you because they might not feed you as much. But the larger consideration, in my minds eye, is if you dance with the "devil" what moral right do you have to claim foul when the host refuses to deliver the blood to the parasite? The investigation is typical "rules of engagement" and, to me at least, no surprise or outrage is warranted.

When I read an article about this I could only shake my head in frustration and anger. That our country keeps allowing the government to take these steps towards socialism and extreme violations of basic rights is amazing to me. Keep up the good work, and keep getting the word out. Your site and the articles on your site are a nice refreshing breeze in this sespool we live in now.

Thank you for presenting this information. Things are happening so fast. First flag@whitehouse.org looking for people dicussing rationing and now, so soon, the silencing of someone who speaks about rationing. I guess they were right when they said it wasn't a game. I'm extremely grateful to the Ayn Rand Center. If we make through, you guys will have played the key role. Thank you

Not only is Senator Baucus limiting free speech, his perspective presupposes that his constituents are incapable of reading an independent opinion and deciding for themselves if it is reasonable. He is in effect telling his constituents how to think. It's a very totalitarian approach - and you're right, it is scary.
